Why was there a lawsuit that wanted to bust Travelers Co. over car betterment?

A potential nationwide class action lawsuit that alleges the company is faced by Travelers Property Casualty Corp.

Keep in mind that this lawsuit wants to be taken in place because implemented auto insurance claims procedures that failed to “fully compensate its policyholders for damage to their automobiles by deducting betterment and depreciation from claims payouts.”

When an insurance company pays to replace a used product with a new product, betterment occurs. However, betterment will not cover the entire cost of the replacement because the policyholder got use of the original.

The Travelers breached its contract with policyholders by deducting for betterment and depreciation which is why it was filed on March 27th, 200 in Province R.I., Superior Court.

Travelers Company “rarely” deducts for betterment, according to Kris Hammond, a spokesperson for Travelers, while not committing on the lawsuit in general. A potential nationwide class action faces one of the nation’s largest auto insurers, Travelers, according to Peter Wasylyk, the Providence, R.L., an attorney representing the plaintiff in this case.

Because deductions for auto betterments are a common industry practice, it might leave some insurers in hot legal water. “Betterment seems to be in the same vein as the use of aftermarket parts and payments for diminished value,” he claims.

Wasylyk claims that there some auto insurers that stopped deducting for better and depreciation such as Allstate and State Farm, but some companies, such as Travelers Auto Insurance Company.

However, because betterment is a common industry practice, insurance specialists claim that they are not surprised once they see it. Travelers, along with other companies, that use this practice, are still in hot legal water and are in danger in meeting lawsuits.

The practice of deducting for betterment has been practiced by some auto insurers including Allstate, State Farm, and 14 other auto insurance face litigation from Texas’ Attorney General.

After the companies are swimming in deep legal water, they are going to be required to respond. Usually, companies, such as Travelers, have 20 days to respond from the date of service. Afterwards, a class action certification hearing will need to take place.
