I heard that California is a sorry state for accidents. What does this mean?

When getting out of the car and saying you're sorry won't be considered that you are liable. This is true in California. In fact, a new law has recently been passed practicing this. This is known as the "sorry law'.

It was enacted in January 1, 2001, and many people still don't know about it. This law is based on a similar legislation already in effect in Massachusetts and has been passed by California State Assemblyman Lou Papan.

According to Papan legislative aide Glenda Hubner, this law does not cover direct admission of guilt and protects only apologies made by parties at the time of the accident. However, saying "I'm sorry' won't indicate that you are to blame, however, saying phrases like, "I'm sorry I didn't see you' or "I'm sorry, it's all my fault' will indicate that you are liable.

You won't have to worry about saying that "you're sorry' in California. This basically prevents you from saying words accidentally that might affect your case in court, even when it wasn't your fault.

If you are liable, saying that you're sorry and admitting that it was your fault will probably prevent having a complex case. However, insurers and lawyers advice for drivers not to express regret for fear it will be used against them and might cause them serious financial harm.

Not only is it now important to choose "sorry' words carefully, but now you need to also be extra careful about how you act when calling the police. Here are some tips you should consider when keeping your cool:

  • Don't stress. Be calm and be prepared for whatever the cop asks you.
  • Describe what happened and every now and then mention that you weren't liable.
  • Avoid saying that you're sorry! Even though it is now a law in California, it is crucial in other states.
  • Be careful about what you say and what you do. Choosing your words wisely is very important.
  • Prepare your documentation and avoid having a nervous breakdown, even when an accident just ruined your day, a schedule or an important event.
  • It is important to have a prepared little packet to show a cop in your car like your vehicle registration documentation, your driver's license and license registration number. Things like these are important.
